Terms and Conditions

1. Agreement to Terms

By accessing or using PilotSocials at app.pilotsocials.com ("the Service"), operated by CodeTix, Barcelona, Spain, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you") and CodeTix ("we", "us", "our").

2. Description of Service

PilotSocials is an AI-powered social media management platform that helps businesses:

  • Create AI-generated social media content based on your brand profile
  • Schedule and auto-publish content to Instagram, Facebook, and TikTok
  • Analyze engagement metrics and marketing performance
  • Manage community interactions (comments, messages)
  • Optimize SEO for your business website

3. Account Registration

To use PilotSocials, you must:

  • Create an account using Google OAuth
  • Provide accurate and complete information about your business
  • Be at least 16 years of age
  • Be authorized to act on behalf of any brand or organization you manage
  • Maintain the security of your account credentials

You are solely responsible for all activity that occurs under your account. Notify us immediately at hello@pilotsocials.com if you suspect unauthorized access.

4. Subscription Plans and Pricing

4.1 Plans

Prices are in EUR and exclude applicable VAT/taxes. VAT will be added at checkout based on your location and applicable tax rates.

4.2 Free Trial

New accounts may receive a free trial period. Details of the trial (duration and included features) will be displayed during registration. No payment is charged during the trial.

4.3 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payment is processed securely through Stripe
  • Annual subscriptions are billed as a single payment for 12 months

4.4 Cancellation

  • You may cancel your subscription at any time through billing settings
  • Cancellation takes effect at the end of the current billing period
  • You retain access to paid features until the billing period ends
  • No partial refunds for unused time within a billing period

4.5 Price Changes

We may change subscription prices with 30 days written notice. Price changes take effect at the start of your next billing period. If you disagree with a price change, you may cancel before it takes effect.

5. Right of Withdrawal (EU Consumers)

If you are a consumer in the European Union, you have the right to withdraw from this contract within 14 days of subscription without giving any reason, in accordance with Directive 2011/83/EU.

To exercise your right of withdrawal, contact us at hello@pilotsocials.com with a clear statement of your decision.

Exception: If you have explicitly consented to the Service beginning during the withdrawal period and acknowledged that you lose your right of withdrawal upon full performance, the right of withdrawal may not apply. By starting to use the Service during the 14-day period, you acknowledge this.

If you validly withdraw, we will refund all payments received from you within 14 days using the same payment method.

6. Acceptable Use

You agree NOT to use PilotSocials to:

  • Publish content that violates any applicable law or regulation
  • Distribute spam, malware, or harmful content
  • Infringe on third-party intellectual property rights
  • Publish misleading, defamatory, or hateful content
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for any illegal purpose
  • Reverse-engineer, decompile, or disassemble the Service
  • Resell or redistribute the Service without our written permission
  • Exceed reasonable usage limits (API abuse, automated scraping)

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

7. AI-Generated Content

7.1 Content Generation

  • Our AI generates content suggestions based on your brand profile, industry, and preferences
  • AI content is generated using third-party AI providers (currently Anthropic Claude)
  • Content quality may vary and is not guaranteed to be error-free

7.2 Your Responsibilities

  • You are solely responsible for reviewing, editing, and approving all content before publication
  • You must ensure content complies with applicable laws and platform terms of service
  • You must verify factual claims in AI-generated content before publishing
  • You are responsible for ensuring content is appropriate for your audience

7.3 Content Ownership

  • You retain full ownership of content created through the platform
  • We do not claim any intellectual property rights over your generated content
  • You grant us a limited, non-exclusive license to process and store your content solely to provide the Service

7.4 AI Limitations

  • AI may occasionally produce inaccurate, inappropriate, or biased content
  • AI-generated content should not be considered professional advice (legal, medical, financial, etc.)
  • We are not liable for consequences of publishing AI-generated content without proper review

8. Social Media Accounts

  • You are responsible for complying with the terms of service of each connected social media platform (Meta, TikTok, etc.)
  • PilotSocials is not responsible for actions taken by social media platforms on your accounts (suspensions, content removal, etc.)
  • You grant PilotSocials permission to publish content on your behalf through connected accounts
  • You may disconnect social media accounts at any time from your dashboard
  • We encrypt and securely store social media access tokens

9. Intellectual Property

9.1 Our IP

The PilotSocials platform, including its design, features, functionality, documentation, and branding, is owned by CodeTix and protected by applicable intellectual property laws.

9.2 Your IP

Content you create, upload, or generate through the platform remains your property. You are responsible for ensuring you have the necessary rights to content you upload.

9.3 Feedback

If you provide feedback or suggestions about the Service, you grant us a non-exclusive, royalty-free license to use such feedback to improve the Service.

10. Data Protection

Your personal data is processed in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR).

By using the Service, you acknowledge that:

  • We act as Data Controller for your account and usage data
  • We act as Data Processor for business content you create and social media data you connect
  • Our sub-processors are listed in our Privacy Policy
  • You have the rights described in our Privacy Policy (access, rectification, erasure, portability, etc.)

11. Limitation of Liability

11.1 Service Disclaimer

The Service is provided "as is" and "as available." To the maximum extent permitted by applicable law, we make no warranties, express or implied, regarding the Service's reliability, accuracy, or fitness for a particular purpose.

11.2 Liability Cap

To the maximum extent permitted by applicable EU and Spanish law, our total aggregate liability for any claims arising from or related to these Terms or the Service shall not exceed the total amount paid by you to us in the 12 months immediately preceding the event giving rise to the claim.

11.3 Exclusions

We shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or errors beyond our reasonable control
  • Actions taken by third-party platforms on your accounts
  • Consequences of publishing AI-generated content without proper review
  • Force majeure events

Note: Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

12. Service Availability and Modifications

  • We target high availability but do not guarantee uninterrupted service
  • We may perform scheduled maintenance with reasonable advance notice
  • We reserve the right to modify, update, or discontinue features with 30 days notice
  • Critical security updates may be applied immediately without notice

13. Termination

13.1 By You

You may terminate your account at any time by cancelling your subscription and requesting account deletion through settings or by contacting hello@pilotsocials.com.

13.2 By Us

We may suspend or terminate your account if:

  • You materially violate these Terms
  • Your payment fails and remains unresolved for 14 days
  • Your use poses a security risk to the Service or other users
  • Required by law or regulatory order

13.3 Effects of Termination

Upon termination:

  • Your access to the Service will cease
  • Your data will be deleted within 30 days (except as required by law)
  • You may request a data export before termination
  • Outstanding payment obligations survive termination

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at hello@pilotsocials.com to attempt to resolve any dispute informally. We will make good faith efforts to resolve disputes within 30 days.

14.2 Governing Law

These Terms are governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles.

14.3 Jurisdiction

Any disputes arising from these Terms shall be submitted to the courts of Barcelona, Spain.

14.4 EU Consumer Rights

If you are an EU consumer, you may also use the EU Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to resolve disputes online. Nothing in these Terms affects your statutory rights as a consumer under applicable EU law.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CodeTix regarding the Service.

15.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

15.3 Waiver

Failure to enforce any right or provision does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.

15.5 Language

These Terms are drafted in English. In case of conflict between translations, the English version prevails.
